Each such person or persons is or are bound by these terms and conditions accordingly;

Amendments
We reserve the right to amend these terms and conditions, from time to time, without notice to you or to any other person. Any amended terms and conditions become binding immediately they are posted on our website.

Governing Rules
SuperDepot is a service providing you with access to current governing rules for your superannuation fund.

The fund trustee is authorised by the trust deed for your fund to make changes to the governing rules from time to time. The trustee has also authorised SuperDepot Pty Ltd ACN 122 036 248 to make changes to the governing rules from time to time and to publish them by uploading to the SuperDepot website.

Any new rules will be uploaded to the SuperDepot website and will apply from the date of upload provided your fund is shown as Active on the website. The version of the governing rules applying to your fund are those made available on the home page for your fund on the SuperDepot website.

By subscribing to SuperDepot and making payment of all fees within our usual payment terms:

  • you agree to all of these terms and conditions;
  • the governing rules of your superannuation fund will be the version of the governing rules applying to your fund on the home page for your fund on the SuperDepot website to the exclusion of all previous governing rules of your superannuation fund.

If you choose to reject any changes or opt out of any particular version of the governing rules:

  • the governing rules which applied to your superannuation fund immediately prior to that version will continue to apply;
  • we will continue to send notices to you when we make further changes to the governing rules while your subscriptions are paid up to date;
  • If you reject any changes or opt out of any particular version of the governing rules, you may accept later updates to the governing rules notified to you;

We recommend that you speak to your professional adviser before rejecting any changes or opting out of any particular version of the governing rules or if you have any questions regarding them.

Responsibility
It is your responsibility as a trustee of your superannuation fund to:

  • familiarise yourself with the governing rules;
  • notify the members of the changes to the governing rules;

We accept no responsibility for any loss or damage arising out of your failure to do so.

If you are a professional adviser responsible for the administration of one or more superannuation funds in the SuperDepot system you represent that you are properly authorised by the relevant trustees to do so on their behalf. We accept no responsibility for any loss or damage arising directly or indirectly from any failure to obtain proper authorisation to do so.

Fees paid for entry to or annual subscription to the SuperDepot are non-refundable. In particular, no part of the annual subscription will be refunded where a fund trustee rejects any changes or opts out of any particular version of the governing rules or where no changes are made to the governing rules in any year.

Disclaimer
We do not provide advice in relation to superannuation, taxation, stamp duty or any other matter. Please note laws relating to taxation, superannuation, trusts and stamp duty are continually changing. We do not warrant that the governing rules used by your superannuation fund and made available through this website comply with the provisions of the Superannuation Industry (Supervision) Act 1993 or with any relevant laws applying to your superannuation fund from time to time.

We do not purport to give advice in relation to the enclosed documents nor should you construe anything in the enclosed documents or any conversation or correspondence as advice of any kind.

We do not accept any responsibility for any loss or damage however caused (including through negligence or fraud) which you may suffer directly or indirectly in connection with your use of this website nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained in or accessed through this website.

  • unauthorised access to the SuperDepot by any person using your log in or password details or those of any other person;
  • alterations to any details of your superannuation fund made by any person using your log in or pssword details or those of any other person.

Unless expressly authorised by these terms and conditions, you must not, without our written consent, in any form or by any means reproduce, copy, publish, print or distribute any part of this website or any content made available through this website except for the proper purposes of the superannuation fund to which it relates.

Platform Integrations
We provide platform integrations with some third party service providers to enable efficiencies in your practice. We access information provided by those third party providers from time to time where that information is provided to them by you.

We use information obtained in this way only for purposes for which the third party provider is authorised to use and supply that information. We do not share any of this information or use it for other purposes.

Any information we receive or obtain this way is subject to our Privacy Policy.

We and our third party providers make all reasonable efforts to ensure that these services are available. Where delays occur in transmission, those services will be made available at the earliest practical time.

The provision of information collect this way and the use of our systems to access that information is on an as is, where is basis and at your own risk.

We do not verify the accuracy of any information provided to us by third parties and rely solely on the accuracy of the information you or your clients have supplied to them.

You have no claim, or right to claim, any interest or property right over, or in relation to, any product or services provided or accessed by you, and no ownership in the copyright or other right in the documents that you order.

Availability
We may withdraw access to this website and your information without notice if:

  • your account is or becomes inactive;
  • electronic or other equipment malfunctions or is otherwise unavailable at any time for use;
  • your account remains unpaid beyond our normal payment terms;
  • we believe that the security of the SuperDepot and/or this website may have been compromised; or
  • we believe that this website or any content available through it is being used for improper or unauthorised purposes.

Password
You must keep your password secure. Failure to do so may result in loss to you. We will not be responsible for the failure or omission of any person which results in any password or other sensitive information being used by any person, whether we have notice of any such use or not.

Retention
If you leave the SuperDepot system for any reason, we will retain the information provided by you regarding your superannuation fund for a period of 1 year following termination unless you instruct us to delete it before that time. That information will be accessible to you on this website for that period. After that period your information will be deleted from our records. We recommend that you print copies of your details and your current governing rules to be retained in your records.
